What I need to learn about web development

I have done research of skills for web developer position and the skills which are most needed are;

HTML/CSS

JavaScripting

XML

PHP/MySQL

Photoshop

Flash Development

Object Oriented Programming

.NET

ASP.NET

Currently I am stydying web design course in Central Tafe and a lot of these requirements will be covered as a part of this course by the end of the second semester. The course will cover: HTML/CSS, JavaScripting, PHP/MySQL, Fireworks and Dreamweaver.

I currently hold a diploma of Business Programming and from my previous job as software developer I have skills in Objected Oriented Programming (VB) and C#, this will be useful too.

Also I am going to stydy Flash on line using this link http://www.adobe.com/devnet/flash/?view=gettingstarted and should finish it at the same time as Web design course July 2010.

What work is not protected by copyright

Copyright Act does not say if names, titles or slogans are protected. However, the use of a name or title which is already used by somebody else might breach other laws like trade mark.

That means that there is no copyright infringement in using somebody else idea, but there might be a breach of other area of law if an idea was communicated to you in confidence or you the people get the impression that you are associated with the person who implemented this idea.

Shape Analysis

Shape analysis is the mainly automatic analysis of geometric shapes, for example using a computer to detect similarly shaped objects in a database or parts that fit together. For a computer to automatically analyze and process geometric shapes, the objects have to be represented in a digital form. Most commonly a boundary representation is used to describe the object with its boundary (usually the outer shell). However, other volume based representations (e.g. constructive solid geometry) or point based representations (point clouds) can be used to represent shape.

Once the objects are given, either by modeling (computer-aided design), by scanning (3D scanner) or by extracting shape from 2D or 3D images, they have to be simplified before a comparison can be achieved. The simplified representation is often called a shape descriptor (or fingerprint, signature). These simplified representations try to carry most of the important information, while being easier to handle, to store and to compare than the shapes directly. A complete shape descriptor is a representation that can be used to completely reconstruct the original object (for example the medial axis transform).

Application fields

Shape analysis is used in many application fields:

archeology for example, to find similar objects or missing parts
architecture for example, to identify objects that spatially fit into a specific space
medical imaging to understand shape changes related to illness or aid surgical planning
virtual environments or on the 3D model market to identify objects for copyright purposes
security applications such as face recognition
entertainment industry (movies, games) to construct and process geometric models or animations
computer-aided design and computer-aided manufacturing to process and to compare designs of mechanical parts or design objects.

There are certain measures you can use in this case:

1. Use the copyright notice.

2. Place an information on the site about what is not permitted to use.

3. Use password-protected access or encryption.

4. Provide only partial delivery of content.

5. Contact the infringer.

6. Take legal advice or legal action.

The law in Australia

The areas of law in Australia which may be used to try and stop the unauthorised use of your image include:

1. defamation;

2. the Federal Trade Practices Act and State Fair Trading Acts; and

3. the law of passing off.

Copyright law is of little assistance in preventing unauthorised use of an image. This is because the person who owns the copyright in an image will generally be the person that created it rather than the person who appears in it.

Rights Management is a strategy that protects your intellectual property from unauthorised use. This strategy may include an inventory of all material on the site, with information about who owns it and what copyright conditions are.

This strategy may be affected by the clearance condition for the material.

You should have a good system for documenting the material you publish on line, its copyright status, and what rights you have for it. It is useful to put into documentation the basis on which you have copyright, if you have whole copyright or the part of it. Copyright protection is an automatic right under international law, but evidence may be required to support your claim in the event of a dispute, so ensuring the best copyright protection for your work relies on several factors.

There are some simple steps you can take to ensure your work is safe.

Ensure you work is properly marked.

Keep or register supporting evidence.

Agreement between co-authors.

Protect your work by including a copyright notice at the end of every article, short story, poem, etc. that you create.

Avoid using copyright symbol. Instead, opt for (c). Some online sites will experience problems displaying special symbols or foreign language characters.

Do not waste lots of time for seaching violators contact information. Thieves will do their utmost to remain anonymous. Trying to locate an e-mail address or other contact information for someone who has stolen your work is usually difficult. These reprobates are good at hiding their tracks, and they are often from foreign countries.

Search for the company that hosts a violators site.

Get consent to publish copyright material

If you want to publish material you found on somebody else website, you will need to get a consent. For example, if you found a photo which you like and want to use on your website you need to write a letter to the owner of this photo, informing this person how you found this photo, that you would like to use it and asking a permission to do it. You need to include in a letter a link to your website as well. When you receive a positive answer from the owner of the photo you can use it on your website.

The simple letter may look like the one below:

Dear Nuk,

I would like to have your consent to use a photo of flower which I found on your website http://be2one.wordpress.com. If you let me to use this photo and have any conditions you would like me to follow, please let me know.

What to include in a copyright clearance.

There are a list of things you need to include in a copyright clearance, mostly they are description of the activities/purposes for which you need clearance. It is very important in a case you want to allow future development or expansion of publishing activity. Clearance needs to allow you to make any reproductions and communications associated with uploading the material to a server and allowing users to view it.

A license can be exclusive and non-exclusive. An exclusive license means that you are the only person entitled to use material.

It is possible that you get a non-exclusive clearance for pre-existing material and an exclusive license for new material you pay someone to create.

You will need to clarify for what countries you make an agreement, how long the clearance should last, conditions and payment. Conditions may depend on a copyright owner.
